PA Lemon Law Protects You if You Unknowingly Purchase or Lease a Lemon Vehicle
PA Lemon Law applies to any new vehicle that was purchased or leased in Pennsylvania for personal use. According to this law, car manufacturers must repair or correct any defect which substantially impairs the vehicle’s use, value, or safety at no cost to the purchaser under the following conditions:
- The defect was reported within 1 year after delivery, or 12,000 miles of use, or the term of the manufacturer’s express warranty, whichever came first.
- The defect could not be repaired after 3 attempts (1 attempt for a safety-related defect), or was out of service for a total of 30 calendar days.
After 1 year or 12,000 miles, you may still be covered under the Pennsylvania Consumer Protection Act, Pennsylvania Uniform Commercial Code, Federal Magnuson-Moss Warranty Act, or other contract remedies. As a rule of thumb, we’re always able to help clients who have had problems with their vehicles at any time during the manufacturer’s warranty period. If the vehicle was not satisfactorily repaired, you may be eligible for a replacement or full refund including sales tax, expenses and attorneys’ fees, minus a limited allowance for use.
Having a lemon law attorney lets manufacturers know you’re serious
Individuals without legal representation are not a threat to car makers. Car manufacturers employ powerful legal teams that routinely “shut down” unassisted individuals with stall tactics and legal intimidation. Conversely, someone with a lemon law attorney at their side will instantly make the manufacturer sit up and take notice.
Court cases cost money and if the manufacturer loses, they must pay court and attorney’s fees. Therefore, it’s in their best interest to settle out-of-court. Having a lemon law attorney will very likely get your case settled before litigation ever begins. If your case does go to court, your attorney will handle all the details and grunt work. If for some reason, we don’t win, you still won’t owe anything because PA Lemon Law dictates that consumers are not responsible for attorney’s fees, regardless of the outcome.
